Delaware Disability Insurance Lawyers

The Law Office of Justin Frankel represents Delaware residents who are facing problems obtaining their disability insurance benefits, when they have been denied disability benefits, when benefits have been terminated, and throughout all stages of their long-term disability (LTD) insurance claims. Delaware residents who are having problems with their disability claims have a number of important decisions to make when it comes to selecting legal representation. While it may seem comfortable to work with local attorneys, disability insurance law is a highly complex area of the law and general practitioners rarely possess the knowledge and experience to succeed in a disability insurance claim.

The Law Office of Justin Frankel can represent Delaware claimants and our geographic location is not a factor in our work on behalf of clients. We have represented clients in most states in America, with the use of phone conference calls, email, video conferences and overnight express mail services, which have eliminated any challenges in obtaining information and preparing legal documents.

You Don't Have to Fight Your Disability Battle Alone

Disability insurance matters that are governed by ERISA, which includes the majority of policies, are first addressed through an administrative ERISA appeals process. This does not involve local courts or local court appearances. If the administrative appeals process should be exhausted, then any ligation takes place in federal court. Again, this process does not require us to have a physical presence in Delaware. Known as a state that is very friendly to corporate entities, many Delaware residents belong to professional associations that offer group discounts on their disability insurance policies. There are however limitations to the advantages that these types of policies provide, some positives and some negatives. By purchasing disability insurance through a sponsoring professional association, the individual gains the buying power of a larger group. The drawback is that policies sold through associations are treated in the same manner as any other group policy – ERISA rules apply to any claims that are in dispute. ERISA guidelines are very strict – deadlines, the appeals process, etc. – and there is little, if any, flexibility for individual situations. However, this may be a far more affordable option for those who need the protection that disability insurance affords and do not wish to make the investment in a private policy. If you are a Delaware resident and have questions about filing for a claim on your disability insurance policy, whether it is a private policy or a group policy, speaking with an experienced attorney with the right credentials could potentially make the difference between a claim that is filed successfully and a battle over your benefits that could extend for several years in duration. We have represented clients at all stages of their claims, in all states across the country. Regardless of your location, we recommend that anyone with a disability policy who is considering filing a claim start the process by researching and selecting an attorney to help them from the very start of the process. There are simply too many points at which the layperson can find themselves placed in a precarious position, from the types of doctor notes to the studies that are submitted for review. If you have questions, call our office at 888-583-4959 today.
