Prudential Disability Claim Reversal for Executive with Rare Meniere’s Disease
Our client, a 54-year-old Assistant Vice President at a prominent American financial services and bank holding company, had built a distinguished career marked by consistent professional achievement and personal fulfillment. Tragically, his trajectory was disrupted by a constellation of debilitating medical conditions, including bilateral Meniere’s disease, Otolithic Crisis of Tumarkin, chronic vertigo, tinnitus, sensorineural hearing loss, migraines with aura, and chronic pain, each contributing to a cascade of severe physical and cognitive impairments.
Among the most disabling aspects of his condition was the Otolithic Crisis of Tumarkin, a rare and extreme manifestation of Meniere’s disease characterized by sudden, unpredictable drop attacks without warning. Bilateral Meniere’s disease itself affects only approximately 15% of those diagnosed with Meniere’s, making his case particularly complex. Despite the use of hearing aids, he experienced profound hearing loss, persistent tinnitus that severely impaired concentration, and frequent migraines with aura. The unpredictable nature of these symptoms rendered him incapable of performing the demanding duties of his executive role or any gainful employment.
His position required sustained cognitive engagement, long hours, and physical stamina. Yet his symptoms, balance and gait instability, fluctuating hearing loss, severe vertigo episodes, and diminished focus, substantially compromised his functional capacity. Following a comprehensive evaluation, his treating physician, a specialist in vestibular disorders, advised him to cease all work and transition to disability leave.
Initially, Prudential approved his short-term disability claim. However, the insurer later reversed its decision, denying the remainder of the claim. Recognizing the need for experienced legal representation, he retained the Law Office of Justin C. Frankel, PC to prepare a robust appeal.
Our firm collaborated closely with his treating specialist to develop compelling medical support for the severity and persistence of his condition. We meticulously refuted Prudential’s flawed medical assessments and mischaracterizations. Shortly after submitting the appeal, Prudential reversed its denial, paid out the full short-term disability benefit, and approved his long-term disability claim based on the same evidentiary record.
This case underscores the challenges faced by individuals suffering from rare and misunderstood conditions like Meniere’s disease with Otolithic Crisis of Tumarkin. Insurance carriers often minimize or dismiss the legitimacy of such claims. At the Law Office of Justin C. Frankel, PC, we are committed to ensuring that our clients receive the benefits they are rightfully owed. If you or a loved one is navigating a similar battle, our experienced disability attorneys are here to advocate for you with precision, compassion, and unwavering resolve.
