Securing Long-Term Disability Benefits from New York Life for a Senior Technical Architect

Over $300 Million Recovered for Our Clients

At the Law Office of Justin C. Frankel, P.C., we pride ourselves on standing up for clients who have been wronged by powerful insurance companies. One such case involved a courageous 61-year-old Senior Technical Architect who was struggling with debilitating medical conditions that made it impossible for him to continue working.

Before hiring our firm, our client had already filed for Short-Term Disability benefits with New York Life but was devastated when his claim was denied. The insurer argued that he was capable of performing work in a “sedentary” capacity despite his long history of chronic, severe medical conditions. Struggling with incapacitating chronic pain and the cognitive impact of his conditions on his functional ability, New York Life’s denial left him feeling abandoned, until he turned to the Law Office of Justin C. Frankel for help.

The Challenges

Our client’s medical history was nothing short of overwhelming suffering from multiple co-morbid spinal conditions including, chronic lumbar radiculopathy, lumbar herniated discs, lumbar spondylosis, foraminal stenosis, degenerative disc disease, chronic pain, and failed back surgery syndrome. Along with three spinal surgeries including multilevel discectomy, laminectomy, foraminectomy, and implantation of an intrathecal pain pump, having pain medication delivered directly to the spinal fluid to manage severe pain.

Despite this exhaustive list of debilitating conditions, which included multiple major surgeries and chronic, intractable pain, New York Life refused to acknowledge the severity of our client’s disability. The insurer’s in-house medical staff and paid consultants repeatedly opined that he was capable of returning to his sedentary occupation as a Senior IT Architect, unwilling to accept or consider the overwhelming cognitive demands of this position.
New York Life’s claim determination was not only medically unfounded, but it was also made in direct contradiction to the opinions of our client’s long-standing treating pain specialist, who steadfastly supported his claim and confirmed that his condition rendered him completely unable to work in any capacity. The insurer’s refusal to recognize the extent of his disability was unjust and egregious.

Our Approach

Undeterred by the initial setback, our firm took immediate action to challenge New York Life’s wrongful denial. We knew that our client was entitled to both short-term and long-term disability benefits, and we were determined to secure those benefits for him.

We carefully reviewed his entire medical history, consulted with additional medical experts, and prepared a compelling case that highlighted the severity of his conditions. Our team meticulously outlined how New York Life had used biased and improper tactics to dismiss the legitimacy of his disability. We uncovered their arbitrary and capricious decision-making process, where they ignored the opinions of treating physicians and relied on flawed, one-sided assessments from their paid consultants and in-house vocational staff.

Our approach was not to back down or accept the unfair treatment our client had experienced. Instead, we pressed forward, relentlessly advocating for his rights and making it clear that we would continue fighting until we had secured the benefits he rightfully deserved.

Victory: Long-Term Disability Benefits Secured

After an intense and protracted battle, New York Life finally relented. The insurance company acknowledged that our client was, in fact, disabled and incapable of returning to work as a Senior Technical Architect. Their decision to approve long-term disability benefits marked a significant victory for our client, who had been left in limbo for so long.

This outcome not only provided our client with the financial security he needed but also delivered peace of mind after a long, difficult journey. The insurer’s acknowledgment of his disability was a hard-fought win that validated his struggles and the relentless support of his treating doctors.

A Client for Life

The success of this case is a testament to our firm’s unwavering commitment to fighting for the rights of those who are wronged by powerful insurers. We were proud to stand by our client and ensure that he received the compensation he was entitled to. This victory represents more than just a financial win—it was a victory for justice, for fairness, and for the dignity of our client.
At the end of the day, we take pride in knowing that our client can now focus on his health and well-being, free from the stress and worry of financial insecurity.

If you’re facing similar challenges with your long-term disability claim, know that we are here to help. We have the experience, the resources, and the determination to fight for the benefits you deserve.
